The Japanese Ministry of Economy, Trade and Industry (METI) appealed the case concerning Japan's tariff on South Korea's Hynix Semiconductor Inc.'s DRAM products to the WTO (World Trade Organization) Aug. 30, 2007.
Hynix has exported its DRAM products to Japan at competitive low prices thus far, while receiving financial aid from the Korean government, according to the METI. Elpida Memory Inc. and Micron Japan Ltd. asked the Japanese Ministry of Finance to levy tariffs on Hynix DRAM to offset this Korean government's aid in June 2004. Japan imposed countervailing duties against Hynix in January 2006.
In June 2006, Hynix filed a complaint against these duties to the WTO, which then set up a panel to examine this issue. The panel ruled July 2007 that part of Japan's countervailing duties was inappropriate. Japan appealed against this ruling this time.
