A small technology company has filed suit against Apple Inc., claiming the iPhone infringes a recently granted patent for technology used to help mobile devices access the Internet.
The suit by the EMG Technology LLC in U.S. District Court for the Eastern District of Texas, seeks unspecified damages.
According to a statement issued by EMG's attorney, U.S. Patent No. 7,441,196 is one of five U.S. patents for navigating the Internet on mobile devices and Internet protocol television. The patent, issued Oct. 21, includes 76 claims covering the display of Internet content reformatted from HTML to XML on mobile devices, according to the firm, Jeffer, Mangels, Butler and Marmaro (JMBM).
Stanley Gibson, a partner at JMBM, described EMG as a brand new company formed to exploit the technology covered by the patent. Gibson said the iPhone was the first product investigated by EMG and deemed to allegedly infringe the patent.
The patent covers the simplified interface of reformatted mobile content to provide optimum viewing and navigation with single touches on a small screen, Gibson said.
The claims contained in the patent are supported by specifications filed in 1999 by EMG Managing Member Elliot Gottfurcht and others, according to JMBM. Additional patent claims include the technology for manipulating a region of the screen for zooming and scrolling, the firm said.
Gibson said EMG has not yet had any contact with Apple about the alleged infringement. After filing the suit Monday, Gibson said the next step would be to serve Apple with the complaint.
