The U.S. Patent and Trademark Office (PTO) has initially rejected 41 claims challenged by Nvida Corp. in seven patents that Rambus Inc. has asserted in litigation against the company, Nvidia said Tuesday .
Nvida said it challenged patent claims that stem from a complaint filed by Rambus last November against Nvidia with the U.S. International Trade Commission (ITC). The ITC opened an investigation into the matter the following month.
The patents involve memory controllers related to graphics processors, Nvidia said.
A spokesperson for Rambus (Los Altos, Calif.) said the PTO's decision on the patent claims is a preliminary one and that Rambus will have the opportunity to respond. PTO patent challenges are typically a long process and the Rambus patents remain valid during the entire process, the spokesperson said.
The ITC's investigation on the Rambus complaint is ongoing, the Rambus spokesperson said, with a hearing scheduled for August.
In addition to the seven patents reviewed thus far, two additional Rambus patents are subject to the same challenge by Nvidia and remain pending before the PTO, Nvidia said. A decision on the final two patents is expected in the next 60 days, according to the company.
