Lexar brings Toshiba to court on Flash technologies

Flash player Lexar Media Inc. today filed a lawsuit against Toshiba Corp., alleging theft of trade secrets and breach of fiduciary duty claims.

The suit, filed in Santa Clara County Superior Court in California cites Toshiba and its subsidiaries, Toshiba America Inc. and Toshiba America Electronics Corp.

Lexar said that since its inception in 1996, including the period from 1997 through 1999 when Toshiba was represented on Lexar’s board of directors, Toshiba had access to and was presented with details of Lexar’s methods of achieving high performance flash devices that Toshiba has now incorporated into its flash chips and flash systems.

Toshiba refused to comment on the legal proceedings.

Lexar also said another suit was recently filed that deals with whether Toshiba infringes 14 of Lexar’s patents.

Earlier this week, Lexar filed an amended complaint in its litigation against Fuji Photo Film USA Inc., alleging that in addition to its flash card products, Fuji Photo’s cameras also infringe Lexar’s patents.
