Toshiba announced has filed a lawsuit against Lexar Media,a designer, marketer and licensor of removable flash-based digital media and card reader products.
The suit claims infringement of Toshiba's patents of memory cards based on NAND flash memories and their peripherals. Toshiba is seeking damages and injunction against further sales of Lexar flash memory cards and related peripherals that it alleges infringe Toshiba's patents.
In a separate release today, Lexar pointed to a November 2002 suit it filed alleging that Toshiba's flash memory products infringe nine Lexar Media patents.
"We believe that Toshiba's litigation is a tactical move on Toshiba's part in response to the patent infringement case brought by Lexar Media," said Eric Whitaker, Lexar's VP and general counsel, in a statement. "Toshiba apparently is asserting its patents against the flash memory chips, which are a component product that Lexar purchases from its suppliers. We intend to vigorously protect our intellectual property and defend against this action."
That case, in which Lexar is seeking damages and injunctive relief against Toshiba, is pending.
