The European Commission has notified member countries that it has made a final determination that Hynix Semiconductor Inc. should be assessed a duty of about 35% on imported DRAMs as a penalty for accepting what the EC found to be illegal Korean government subsidies, according to sources.
The member countries will vote on the recommendation by late August. The action comes after the U.S. Commerce Department last month imposed a 44.71% duty against Hynix.
The U.S. International Trade Commission will decide by the end of this month if the U.S. DRAM industry has been injured, determining whether the tariff will be enforced.
