A patent infringement appeal from Infineon failed to make the roster of the U.S. Supreme Court's preliminary short list of cases it will hear this year, according to the news sources.
On Tuesday, the Supreme Court listed 10 appeal cases it will take up this year for hearing. Infineon appeal case was not on the preliminary list. Legal sources said it is not known or confirmed until a complete list released next Monday.
The Circuit Court of Appeals had previously overturned a lower court rulings that the Infineon did not violate Rambus' synchronous DRAM patents as well as findings of fraud against Rambus for failing to disclose its synchronous patents during an industry JEDEC standards body meetings. Infineon had hence sent its appeal to the Supreme Court for review.
If the Supreme Court refuses to hear the Infineon appeal, the case then would return to the original federal district court in Richmond, Va. for retrial.
