U.S Supreme court declines to take up Infineon 's DRAM case

Tuesday, October 7, 2003 The U.S. Supreme Court has declined to take up the appeal of Infineon Technologies in its synchronous DRAM patent infringement litigation with Rambus.

Failure to get the appeal on the Supreme Court docket means Infineon has exhausted all avenues of appeal from a January ruling of the U.S. Court of Appeals for the Federal District, a decision that favored Rambus.

The case now goes back to the original federal district court in Richmond, Va., which will retry Rambus' suit and its claims that Infineon's SDRAM and DDR memory chips violate Rambus's patents.

Rambus is seeking to collect SDRAM and DDR royalties from Infineon and two other memory chipmakers -- Hynix Semiconductor and Micron Technology -- which it is also suing.
