Rambus moves forward on suit against Infineon

Friday, January 9, 2004

Rambus got the greenlight from a federal court in Virginia to continue its $100 million patent-infringement suit against Infineon Technologies. The court, however, narrowed the scope of infringement complaints to only 4 out of 50 that Rambus has filed.

"We are very pleased that the stay was denied and that the case will be going forward," said John Danforth, Rambus general counsel.

Rambus previously took Infineon to trial and lost in 2001 when Rambus was also found guilty of fraud. Infineon had originally accused Rambus of not disclosing required information at meetings between chip companies where industry standards are set.

On appeal, the fraud ruling was vacated and Rambus was allowed to proceed with its own infringement suit against Infineon.

Rambus also has cases planned or pending against Micron Technology and South Korea-based Hynix. Although separate issues, a deal between Micron and the Justice Department could potentially weaken Micron's position in its ongoing legal dispute with Rambus, and possibly lead to a settlement in Rambus' favor, according to analysts.
