The World Trade Organization (WTO) have overturned a previous decision and ruled against Hynix Semiconductor Inc. concerning illegal DRAM subsidies.
In the decision, the WTO upheld duties on DRAM imports in the United States from South Korea's Hynix.
Following those events, the WTO last year ruled in favor of Hynix concerning a complaint against the imposition of countervailing tariffs by the U.S. Department of Commerce.
The U.S. government appealed that decision. In the ruling on Monday, the WTO's appellate body overturned a WTO dispute settlement panel report that found fault with the U.S. Department of Commerce's earlier findings.
The WTO originally "failed to apply the proper standard of review and, therefore, failed to comply with its obligations," according to the organization.
"The ruling leaves U.S. measures in place despite Korean objections," according to a report from the Associated Press.
Recently, the WTO ruled against the European Union's countervailing duties on Hynix chips imported from South Korea. The WTO said the EU should reconsider its duties but did not go as far as Hynix had sought and order an immediate stop to the duties.
