Samsung's Suit Against Rambus Dismissed in Virginia


Wednesday, November 9, 2005 A judge in Virginia threw out Samsung Electronics 's lawsuit over four patents against the computer chip designer Rambus Inc., allowing Rambus to focus its legal strategy on cases in California.

U.S. District Court Judge Robert Payne in Richmond, Virginia, today granted Rambus's request to dismiss the suit after Rambus said it no longer planned to seek royalties from Samsung for the patents.

Rambus's action removes the litigation from Payne's court, where the company in March lost a key ruling over the same patents against Infineon Technologies AG. Payne said he would block Rambus from enforcing the patents against Infineon as punishment for Rambus's destroying documents sought in the case. Rambus faced the same outcome in the Samsung case, the judge said.

``Rambus has succeeded in avoiding, in this action, the risk of a declaratory judgment that the patents-in-suit are neither enforceable nor valid against Samsung,'' Payne wrote in today's decision.

Rambus backed away from the fight with Samsung after the judge refused to transfer the suit to California and said he would use the document evidence. Payne said he will hold a hearing Dec. 15 to determine whether Rambus should pay Samsung's legal fees.

Rambus, based in Los Altos, California, designs chips used in computers and home electronic equipment. Intel Corp., the world's biggest semiconductor company, is Rambus's largest customer.
