Personal computer maker Gateway Inc. said on Thursday (Dec. 8) that the International Trade Commission overturned on appeal an earlier finding that Gateway PCs infringed on some Hewlett-Packard Co. patents, according to a Reuters report.
Gateway said the commission has remanded the case to an administrative law judge for further proceedings related to issues raised by both Gateway and HP, the report said.
The patents reportedly involve parallel port technology, which allows data to be moved around on PCs.
"We're very pleased that the ITC concurred with our view that the Gateway intellectual property and technology at issue in this case does not infringe HP's patents," Michael Tyler, Gateway's chief legal officer, was quoted as saying in a statement.
The appeal is part of a running battle between HP and Gateway on a number of different patents and technologies. HP first sued Gateway in March 2004 and Gateway countersued.
