An administrative judge from the U.S. International Trade Commission (ITC) rejected claims by Toshiba Corp. that Hynix Semiconductor Inc. infringed upon its NAND flash-memory patents, according to a report from Reuters.
Administrative Law Judge Paul Luckern dismissed infringement allegations by Toshiba (Tokyo). The decision is subject to review by the full trade commission and could ultimately be appealed in federal court, according to the report.
Toshiba and Hynix (Seoul) entered into a patent cross-licensing agreement in August 1996 that included semiconductor products. The companies started negotiating an extension of the agreement prior to its Dec. 31, 2002 expiration, but failed to agree what would be reasonable fees for access to Toshiba patents.
Toshiba in 2004 filed a pair of suits against South Korea's Hynix Semiconductor in Japan and the United States over DRAM and flash-memory patents.
